Rear End Collision

I am posting this due to my father's (2016 HRV owner) recently having been rear ended, while he was sitting at a stop light, by another driver who never braked. The HRV was totaled and they had to remove a back door to extricate him from the vehicle. Now my Dad lays in a hospital bed, permanently paralyzed from the waist down.

Has anyone else (or know someone who has) had a rear-end accident in their HRV and suffered significant back injuries? And if so, was there any problem associated with the structure or integrity of the vehicle?

The culpability of the vehicle is easily determined by a certified accident/collision engineer. Every good lawyer has one at his disposal.Pray that the actual strike can be blamed on the other party. If it is a design defect, it will move to a class action and take years to settle.

Get a good lawyer on a contigency contract for the crash, a class action will take a team that MIGHT take it on contigency. search NTSA/Lexis docs for prior HRV rear end cases.....

I'm thinking the liability should be more the driver responsible for the rear end collision than the design and construction of the HRV. The 2019 HRV received a 5 Star overall crash rating from the NHTSA. Very sorry to hear of your dad's misfortune, wishing him a full and speedy recovery.

Wow!

So sorry, man.

But it sounds like you still have your dad, which is very positive, considering...

I drive a lot, always have... it's a jungle out there.

It's unfortunate, but due to the fact that neither the IIHS nor NHTSA perform any meaningful rear crash tests, a lot of manufacturers (Volvo, Mercedes, and Subaru being the exceptions) skimp on that aspect crash safety. Far too many companies build the cars for the tests rather than real world safety, which is why they're usually caught with their pants down whenever a new test is introduced.

Don't forget that the HRV is still a subcompact Fit underneath the skin, so you should expect it to perform similarly to the Fit in a crash test.

Were the rear seats flat? That's the only way I could possibly see something influencing the seat back and maybe pushing into him. Either way, sorry for the misfortune, as others have said at least he's still with you.

Anecdotally I don't think we've had any rear end collisions posted here, just side impacts. Perhaps that's because they're not severe enough to post, or any other number of reasons.

Update

Thank you all for the response. We have hired some very good Attorneys to look into this. Looking at the injuries sustained by my father in comparison to the vehicle damage, my assumption is that it was the other driver's momentum that caused them.

Unfortunately Rowdy, the other driver wasn't asleep. The driver apparently was under the influence of drugs.
